Terms of Service and Conditions of Use

Please read these Terms of Service carefully before using CaseFill.
These Terms of Service (the "Agreement" or "Terms") are a legally binding agreement between CaseFill, a business operated by Jonathan Flores ("CaseFill," "Company," "we," "us," or "our"), and you ("User," "you," or "your"). They cover your access to and use of our website, web application, software, automation tools, document generators, and any related services (together, the "Platform" or "Services"), whether at casefill.org or inside Claude.
BY ACCESSING, BROWSING, CREATING AN ACCOUNT, OR USING ANY PART OF THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU MAY NOT USE THE PLATFORM AND MUST STOP USING IT IMMEDIATELY.
1. No legal advice, no attorney-client relationship
1.1 Self-help software and automation only
The Platform is an automated self-help software tool that helps you fill in standard, publicly available court forms and organize your own records. It fills in forms with the information you type or add, formats papers on pleading paper, numbers exhibits, and lists dates it finds in your papers. CaseFill is not a law firm, does not act as your attorney, and does not provide legal advice, legal opinions, litigation strategy, or representation. CaseFill is not a Legal Document Assistant (LDA) under California Business and Professions Code section 6400 and following, and no one at CaseFill prepares documents for you. You use the software yourself.
1.2 No attorney-client relationship
No communication, automated output, prompt, email, customer support message, or document generated through the Platform creates an attorney-client relationship, confidential relationship, or fiduciary duty between you and CaseFill, Jonathan Flores, or anyone working with CaseFill. Communications with us are not protected by attorney-client privilege or the work-product doctrine.
1.3 No legal interpretation
The Platform and the people who run it do not:
- Review your answers, documents, or data for legal sufficiency, legal consequences, factual accuracy, or procedural correctness. The Platform's checks look only for clerical problems, such as blanks, totals, spelling, answers in the wrong box, identifiers to redact, and dates, and they can miss things.
- Choose legal forms for you or recommend claims, defenses, or remedies. Lists of forms follow the California Courts self-help guides and uscourts.gov; they describe what is commonly filed, not what you must file.
- Interpret local, state, or federal statutes, case law, or rules of procedure for you.
- Apply the law to the facts of your situation.
1.4 Not affiliated with any court
CaseFill is independent. It is not run by or connected to the Judicial Council of California, any superior court, or any federal court.
1.5 Get independent legal advice
Court procedures, filing rules, statutes of limitations, and local court rules vary and change often. The materials and documents on the Platform are general and may not fit your situation or court. You are strongly encouraged to consult a licensed attorney, a legal aid organization, or your court's self-help center about your rights, deadlines, and filing requirements.
2. Your responsibility and assumption of risk
2.1 Who uses the Platform
You represent that you are using the Platform either as a self-represented party (pro se) handling your own matter or managing your own records, or as a licensed attorney, a paralegal working under an attorney's supervision, or a legal aid worker using it in your work. Legal professionals remain fully responsible for their own professional duties.
2.2 Sole responsibility for filings and deadlines
You are solely responsible for:
- Making sure everything you enter is true and complete. Many court forms are signed under penalty of perjury.
- Reviewing, editing, fact-checking, and verifying every generated document before you sign, file, or serve it.
- Following all court rules, local forms, filing methods, formatting requirements, filing fees, service of process rules, and evidence rules.
- Tracking, calculating, and meeting all deadlines, response dates, hearings, and statutes of limitations. Deadlines the Platform shows are estimates from general rules; the dates on your papers and the court's orders control.
- Leaving out or redacting private information the rules require, such as full Social Security and financial account numbers (California Rule of Court 1.201; Federal Rule of Civil Procedure 5.2).
- Keeping your own copies. CaseFill stores your case files only in your browser, and clearing your browser's data deletes them.
2.3 Rejected filings and adverse rulings
TO THE EXTENT THE LAW ALLOWS, CASEFILL IS NOT LIABLE FOR ANY REJECTED FILINGS, PROCEDURAL DEFECTS, DEFAULT JUDGMENTS, FINES, COURT SANCTIONS, ADVERSE RULINGS, OR LOSS OF RIGHTS RESULTING DIRECTLY OR INDIRECTLY FROM YOUR USE OF THE PLATFORM OR ANY DOCUMENT GENERATED WITH IT.
3. Eligibility, accounts and your data
- Age. You must be at least 18 years old (or the age of majority where you live) to use the Platform.
- Your account. You need a free account to use the CaseFill app on casefill.org. You sign in with Google or with a one-time link sent to your email. Use your own account, keep access to your email and Google account secure, and sign out on shared computers. You are responsible for activity under your account and agree to tell us promptly at [email protected] about any unauthorized use.
- Where your case files are. Your account lets you in; it does not store your case files. They stay in the browser where you made them, so signing in somewhere else won't show them. Our Privacy Policy explains exactly what is stored and where.
- Accuracy. You confirm that the information you enter is true and correct to the best of your knowledge.
- Suspension and deletion. We may suspend accounts used to abuse the service, such as flooding sign-in emails. You can ask us to delete your account at any time.
4. Fees, free use, donations and subscriptions
4.1 Free use and trials
CaseFill is free to use during early access. We may offer some features, tools, or document sets free or as a limited-time trial, and we may change, limit, or end free use or trials at any time. If paid features are added, the price will be shown before you pay, and these Terms will be updated first.
4.2 Voluntary contributions
You may choose to make a voluntary contribution to support the Platform. A contribution is a gift: it does not buy, prepay or earn credit toward any membership, subscription, feature, document or service, now or in the future, and it does not change what the Platform does for you. CaseFill is a business, not a charity, so contributions are not tax-deductible. Contributions are voluntary and, except as required by law, non-refundable. Contributing does not give you any ownership interest, legal representation, special treatment in any court matter, or any promise that documents will be accepted.
4.3 Paid subscriptions and renewals
If you sign up for a recurring subscription, it renews automatically at the billing period shown at checkout (for example, monthly or yearly) unless you cancel before the renewal date. You authorize us, through our third-party payment processor, to charge the applicable fees to your payment method.
5. Intellectual property
- Court forms are published by the courts and belong to them.
- The Platform, including its software code, design, workflows, explanatory text, brand assets, and logos, is owned by or licensed to CaseFill and protected by copyright, trademark, and other laws.
- Your license. We give you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Platform for your own matters or, for legal professionals, in your work. You may not copy, resell, or misrepresent the Platform.
- Your data. You keep full ownership of the facts, data, and completed documents you create with the Platform.
6. Prohibited uses
You agree not to:
- Use the Platform to engage in the unauthorized practice of law, to prepare documents for other people for a fee unless the law allows you to (for example, as a licensed attorney or a registered Legal Document Assistant), or for any fraudulent purpose.
- Submit false, perjured, fabricated, or misleading information in court documents.
- Fill in, sign, initial or change any part of a document that someone else must complete, such as a provider's attendance record, a supervisor's hours log, a meeting chair's initials or a letter writer's statement, or use the Platform to make a record of attendance, service, payment or any other event that didn't happen. CaseFill templates leave those parts blank on purpose, for that person to complete and sign.
- Reverse engineer, decompile, scrape, copy, or extract the Platform's software, logic, or source code.
- Interfere with or disrupt the security or operation of the Platform, its servers, or its networks.
7. Disclaimer of warranties
TO THE MAXIMUM EXTENT ALLOWED BY LAW, THE PLATFORM, SERVICES, FORMS, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
CASEFILL EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE PLATFORM WILL MEET YOUR LEGAL NEEDS OR ANY COURT'S REQUIREMENTS;
- WARRANTIES THAT GENERATED DOCUMENTS WILL BE ERROR-FREE, UNCHALLENGED, OR ACCEPTED BY ANY CLERK, JUDGE, OR TRIBUNAL;
- WARRANTIES THAT FORM LISTS ARE CURRENT (Judicial Council forms are usually revised on January 1 and July 1; check that you have the current version at courts.ca.gov); AND
- WARRANTIES OF CONTINUOUS, UNINTERRUPTED, OR ERROR-FREE ACCESS.
8. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, IN NO EVENT WILL CASEFILL, ITS FOUNDER (JONATHAN FLORES), OR ITS OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR:
- ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, LEGAL COSTS, ADVERSE JUDGMENTS, FINES, DELAYS, OR EMOTIONAL DISTRESS) ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE PLATFORM; OR
- ANY CLAIMS RESULTING FROM MISSED DEADLINES, REJECTED FILINGS, DEFECTIVE SERVICE OF PROCESS, CLERICAL MISTAKES, LOST DATA, OR UNFAVORABLE LEGAL OUTCOMES.
IN ANY EVENT, THE TOTAL LIABILITY OF CASEFILL AND ITS AFFILIATES FOR ALL CLAIMS UNDER THESE TERMS IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE TOTAL AMOUNT YOU PAID CASEFILL IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some places do not allow these limits, so they may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless CaseFill, Jonathan Flores, and CaseFill's officers, employees, contractors, and agents from any claims, liabilities, damages, losses, expenses, court fines, and reasonable attorney fees arising from or related to:
- your access to or use of the Platform and any documents you generate;
- any document you file, serve, or present in any court, arbitration, or government proceeding;
- your breach of these Terms; or
- your violation of any third party's rights, court rules, or laws.
10. Dispute resolution: binding arbitration and class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
10.1 Informal resolution first
Before bringing a claim, you agree to try to resolve the dispute informally by emailing [email protected] with a written description of the issue.
10.2 Binding arbitration
If the dispute is not resolved within forty-five (45) days, any dispute, claim, or controversy arising from or relating to these Terms, your use of the Platform, or documents generated with it will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") or JAMS under its consumer arbitration rules. Either party may instead bring an individual claim in small claims court if it qualifies.
10.3 Class action waiver
YOU AND CASEFILL AGREE THAT ANY PROCEEDING TO RESOLVE A DISPUTE WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO ACT AS A CLASS REPRESENTATIVE OR CLASS MEMBER IN ANY CLASS ARBITRATION OR LAWSUIT AGAINST CASEFILL.
11. Governing law, changes and severability
- Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
- Changes. We may update these Terms. The date at the top shows the latest version. If we make important changes, we will ask you to review and accept the new Terms before you continue using the app.
- Severability. If any part of these Terms is found invalid or unenforceable, the rest stays in effect.
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and CaseFill about the Platform.
